Terms & Conditions
These terms and conditions apply to the Echo app (hereby referred to as “Application”) for mobile devices created by Krom (hereby referred to as “Service Provider”) as a free service, provided ‘AS IS’.
Acceptance of Terms
By downloading or using the Application, you agree to these Terms and Conditions. Please read them carefully before using the Application. If you do not agree, do not use the Application. These Terms apply in addition to any applicable privacy policy.
Account Requirement
To use the Application, you must create an account with your name, email address, and password. The Application cannot be used without an account. You are responsible for maintaining the confidentiality of your account credentials.
User-Generated Content
Within the Application, you can create personal reflections and optionally share them with other users or groups. You retain ownership of all content you create. By using the Application, you grant the Service Provider a limited, non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of operating and providing the Application. The Service Provider will not use your content for marketing or any other purposes outside the Application.
Intellectual Property
The Application, including all content, design, code, and trademarks, is owned by the Service Provider. You may not copy, modify, reverse engineer, or create derivative works of the Application or any of its content. All rights not expressly granted remain with the Service Provider.
Use of the Application
The Application is provided “as is.” The Service Provider does not guarantee uninterrupted access, and you are responsible for ensuring your device has sufficient battery and a stable internet connection. Any data charges from your mobile provider, including roaming fees, are your responsibility
Updates and Termination
The Service Provider may update, suspend, or discontinue the Application at any time without prior notice. Updates may be required to continue using the Application, and by using the Application, you agree to download updates when offered. While the Service Provider strives to maintain compatibility with current operating system versions, they do not guarantee that the Application will always be fully compatible with your device. Upon termination, all rights granted to you under these Terms end, and you must cease using and, if necessary, delete the Application from your device.
User Data and Privacy
The Application stores the personal data you provide, including your name, email address, password, reflections, and groups. You can permanently delete your account and all associated data directly within the Application. For assistance, contact support@thisisecho.app.
The Application does not automatically collect personal data, such as device identifiers, IP addresses, analytics, crash reports, or performance data. The Service Provider does not sell or share your information for marketing purposes.
The Application uses trusted third-party services (Vercel, DigitalOcean, Firebase Authentication) solely to operate and maintain the Application. These providers process your information strictly under the Service Provider’s instructions and do not use it for any independent purposes, including marketing
All processing of your personal data is governed by our Privacy Policy.
Children
The Service Provider does not knowingly collect personal information from children. Users must be at least 16 years old to consent to the processing of personal data unless parental consent is provided where required by law. If you believe a child has provided personal information, please contact support@thisisecho.app.
Security
The Service Provider implements procedural and electronic measures to protect your data, including limiting access to authorized personnel. Physical security of servers and infrastructure is maintained by trusted third-party providers (Vercel and DigitalOcean). While reasonable security measures are in place, no system can guarantee complete protection against breaches. You are responsible for maintaining the security of your device and access to the Application. The Service Provider is not liable for any issues arising from unauthorized access, device compromise, or failure to follow security best practices.
Limitation of Liability
To the maximum extent permitted by law, the Service Provider is not liable for any:
- Loss or corruption of content you create or share.
- Costs or limitations from your mobile network, including data usage and roaming charges.
- Responsibility for obtaining permission from the bill payer if you are not the primary account holder of the device.
- Device malfunctions, battery issues, or connectivity problems
- Errors or inaccuracies arising from reliance on third-party services.
- Indirect, incidental, or consequential damages, including but not limited to loss of profits, revenue, or data.
Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or the use of the Application will be resolved exclusively in the courts of the Netherlands. Some jurisdictions do not allow the exclusion or limitation of certain liabilities, so some of the above limitations may not apply to you.
Changes to Terms
The Service Provider may update these Terms periodically. Updated versions will be posted on this page. Significant changes will also be notified within the Application. Continued use of the Application constitutes acceptance of these changes.
These terms and conditions are effective as of 22-10-2025.
